Terms of business

1.0 New Accounts
1.1 Credit accounts are available for bone fide dealers/hire companies, subject to credit status and approval.
1.2 To open an account please contact credit control for an application form.
1.3 Midland Power reserves the right to refuse or withdraw credit facilities without giving reason.

2.0 Payment Conditions
2.1 All invoices are due for payment within 30 days of the invoice date.
2.2 B.A.C s payments for accounts are accepted, details are available from credit control.
2.3 Credit card payments for orders are accepted, details are available from the invoicing dept.
2.4 Overdue accounts may result in orders being delayed until settlement of the account has been made.
2.5 Midland Power reserves the right to recover debt or goods at its discretion.

3.0 Orders
3.1 Please quote Midland Power part numbers wherever possible and please be sure to clearly state your name, account number (if applicable) and delivery address.
3.2 Items priced in minimum numbers cannot be supplied in smaller quantities or in other than multiples of the listed packs.
3.3 Item(s) on back order for more than 90 days will be cancelled.
3.4 Item(s) on back order that are to be cancelled must be put in writing and submitted to the sales office.
3.5 Proforma orders are accepted from non-account holders. Details are available from the sales office.

4.0 Carriage - Online Ordering (from Midland Power's Website Only)
4.1 Carriage paid on all spare parts orders placed via the website (Zone 1 only).
4.2 Orders below £30 incur a £3.95 administration charge.
4.3 Zone 2 - £185 carriage paid on spare parts orders.
4.4 Zone 3 - £225 carriage paid on spare parts orders.

5.0 Carriage - Phone / Fax Orders
5.1 Zone 1 orders of a nett value of £95.00 or more will be sent carriage paid (*excluding machines). On orders below £95.00 nett, carriage / packing will be charged @ £7.95.
5.2 Zone 2 orders of a nett value of £225.00 or more will be sent carriage paid (*excluding machines). On orders below £225.00 nett, carriage / packing will be charged @ £14.95.
5.3 Zone 2 orders of a nett value of £275.00 or more will be sent carriage paid (*excluding machines). On orders below £275.00 nett, carriage / packing will be charged @ £19.95.
5.4 Back orders are sent free of carriage.
5.5 * Carriage for machines - Quotes available from our sales office.

6.0 Delivery
6.1 All orders are normally despatched on the day of receipt. Zone 1 parcels are sent on next day carriers. For pallets a 2-3 day service is used unless otherwise requested.
6.2 Outside Zone 1, a 2-3 day service is used.
6.3 Midland Power does not guarantee these services and cannot be held responsible for delays.
6.4 Guaranteed next day delivery is available on request. Carriage will be charged depending on the weight and destination. Full details of this service are available from the sales office.

*Carriage Zones
Zone 1 - Mainland England, Wales & parts of Scotland
Zone 2 - Scotland postcodes IV & KW, Western Isles, Isle of Man, Scottish Islands & Shetland
Zone 3 - Ireland

7.0 Returns/Shortages/Damage/Defective Goods
7.1 Claims for shortages and damage must be notified to Midland Power in writing within four working days of receipt of goods.
7.2 Replacement goods for damaged/defective items will be charged for and credited on return of said goods once a satisfactory inspection has taken place.
7.3 Goods incorrectly ordered will only be accepted back under the following conditions;
(A) That the goods are in saleable condition.
(B) That the original packaging is still intact.
(C) A 20% handling charge will be levelled for admin costs.
(D) No credit will be given with regards to returned carriage.


7.4 Goods that have been specially ordered in and are a non-stock item will not be accepted back for credit.
7.5 Items for credit will not be accepted back later than 30 days after the invoice date.
7.6 In the case of error by Midland Power, the goods will be collected without charge.
7.7 Authorisation must be obtained in the form of a returns note number for all returns, failure to include this with the returned goods will result in the claim being rejected and the goods returned with carriage being charged.

8.0 Warranty
8.1 Any parts supplied under a warranty claim will be charged in the normal way. A credit will be issued on receipt and satisfactory inspection of the defective goods.

9.0 Identification
9.1 Any reference made by Midland Power to manufacturers models and numbers is for reference only.
9.2 All Midland Power parts are warranted by Midland Power Machinery Distributors.

10.0 Pricing/Specification
10.1 Midland Power reserves the right to change prices and or specification without prior notice.
